Shaanxi Regulations on Patents Comes into effect as of October 1

Yesterday, the Standing Committee of Shaanxi Provincial People's Congress organized to implement the Shaanxi Regulations on Patents which will come into effect as of October 1, 2012.

Shaanxi Regulations on Patents were reviewed and approved in the 30th Session of the Standing Committee of the 11th Shaanxi Provincial People’s Congress. It will come into effect as of October 1, 2012. The Regulations strengthen the incentives for patent innovation. According to the Regulations, the people's governments at or above the county level should establish the special funds for the patent promotion and protection for patent applications, implementation and enforcement assistance. The Regulations perfect the incentives for service inventors and adjust the amount of rewards on the basis of the national standard, and higher than the national standard. Furthermore, the Regulations perfect the patent utilization system to encourage the utilization of patents through tax incentives, government procurement, patent pledge loans, venture capital compensation and patent shares. In order to improve patent protection system, rectify and restrain the illegal actions that damage the legal rights and interests of patentees, the Regulations also strengthen the protection of intellectual property rights from the aspects of legislative protection, administrative protection, judicial protection and relief.

Officials from Shaanxi Provincial Intellectual Property Bureau stated that Shaanxi will pay close attention to the study and formulation of measures for implementation of the Regulations, further improve the patent administration system and provide strong patent management law enforcement officers so as to guarantee according to laws. Moreover, the Regulations defined the incentive systems of fiscal affairs, taxation, financial services, government procurement and patent incentives. The patent administrative departments at all levels should strengthen coordination and refinement of the implementation of the supporting measures to create a better environment for patent innovation, utilization and protection. Meanwhile, Shaanxi will practically improve the effectiveness of the patent administrative protection to protect the legal rights and interests of patentees.
